Consent, Acknowledgement and Release
You hereby acknowledge and agree that: (i) you have read and agree to be bound by all terms and conditions set forth in this submission; (ii) the information that you submit is honest and accurate and you meet all the eligibility requirements set forth herein; (iii) you grant Michael C. Fina Co., Inc. (“MCF”) the right to use your Personal Attributes (defined below) in connection with various commercial and promotional activities, in any and all media now or hereafter known (including but not limited to print and Internet, film, videotape and DVD). “Personal Attributes” consists of your name, address, image, likeness, appearance, voice, performance, statements, biographical and other information and attributes recognizable by you in connection with this submission and selection process; (iv) this submission and any other materials submitted by you (including any photos) become the property of MCF and will not be returned, (v) you shall have no right to inspect or approve any materials prior to their use, nor shall you be entitled to any payment or other consideration, now or in the future; and, (vi) all decisions by MCF concerning this submission and selection process are final and not subject to any challenges or appeals.
To the extent that you provide any professional photographic work, you represent and agree that you have the right and license to have MCF reproduce, distribute and publicly display such photos for all purposes, including in connection with advertising and promotional campaigns in print, on the Internet and by any other means and media now or hereafter known. MCF shall use good faith efforts to credit the photographer where appropriate using the credit information supplied by you, but its failure to do so shall not constitute a breach by MCF.
By acknowledging these terms and conditions in the place so indicated below, you: (i) shall take such steps and execute all additional documents as may be requested by MCF, and to follow all additional rules and instructions that may be provided by MCF; (ii) agree to release and hold harmless MCF, its employees, agents, officers, directors and successors and assigns from and against any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind arising out of your submission, the use of your Personal Attributes, or the participation in any aspect of MCF’s promotional activities; (iii) waive all rights to claim direct, punitive, incidental, indirect and/or consequential damages or any other damages of any kind; (iv) have the right and authority to consent to these terms and conditions and that no rights granted herein violate the rights of any other person; and, (v) agree that you have read and understood all of the terms and conditions set forth in this submission, and consent to these terms and conditions.
